Draft — to be reviewed by a lawyer before launch
Terms of Service
These terms are the agreement between you and IceBreaker. We've tried to keep them short and readable. By creating an account or using the app, you agree to them, together with our Community Guidelines and our Privacy Policy.
1. Who we are
IceBreaker is provided by [OPERATOR NAME], a sole proprietor based at [ADDRESS], Italy, VAT number (P.IVA) [VAT NUMBER] ("IceBreaker", "we", "us"). You can reach us at aakashnandrajog.work@gmail.com.
2. What IceBreaker is
IceBreaker is a free app that helps adults who are free at the same time meet people nearby. You can go online for 1 to 3 hours and share an approximate location with people within a distance you choose (1 to 10 km), say hi to someone with a short note, and, if they accept, chat (up to 10 text messages per chat) and share your location to meet up. Features may change over time as we improve the app.
3. Who can use IceBreaker
To use IceBreaker you must:
- be at least 18 years old;
- be able to enter a binding contract, and not be barred from using the service under applicable law;
- not have been convicted of a sexual offence or a violent crime, and not be required to register as a sex offender anywhere;
- not have had an IceBreaker account removed by us, unless we've told you that you may come back.
IceBreaker is intended for people in the European Union.
4. Your account
- You sign in with your phone number, Google, Apple or email. Keep access to that account secure — you're responsible for what happens on your IceBreaker account.
- The information you give us must be true. Your date of birth must be your real one; it can't be changed after sign-up except by contacting us.
- One account per person. Your account is personal: don't share it, sell it or let someone else use it.
- You can delete your account at any time in Settings → Delete account. See Delete your account.
5. Acceptable use
You agree to follow our Community Guidelines. In particular, you must not:
- impersonate anyone or use photos that aren't of you;
- harass, threaten, bully, stalk or intimidate anyone, or keep contacting someone who has declined or blocked you;
- post or send hateful, discriminatory, violent, sexually explicit or nude content;
- involve, depict or sexualise anyone under 18 in any way;
- scam, defraud or ask anyone for money or financial information;
- use IceBreaker for commercial purposes, advertising, promotion, recruiting or sex work;
- use bots, scrapers or automated means, fake your location, or try to work out someone's exact location;
- try to get around our limits (such as the message cap or a block) or interfere with the app, its servers or its security;
- break the law, or encourage anyone else to.
6. Meeting people — your safety
IceBreaker introduces you to people you don't know. We don't run criminal background checks or verify the identity of our users, and we can't control what people do outside the app. You're responsible for your own interactions with other users, online and in person. Please read our Safety tips, meet in public places, and report anyone who makes you feel unsafe. In an emergency, call 112.
7. Your content
- You keep ownership of the photos, text and other content you add to IceBreaker ("your content").
- You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, resize and display your content only to operate and improve IceBreaker — for example, showing your profile to other users. This licence ends when you delete the content or your account, except for content we must keep for safety or legal reasons as described in our Privacy Policy.
- You confirm you have the right to share your content, and that it doesn't break these terms or anyone else's rights.
- We don't use your content for advertising, and we don't sell it.
8. Moderation, suspension and termination
- Anyone can block or report other users. We review reports and may remove content, restrict features, or suspend or delete accounts that break these terms or our Guidelines, or that put others at risk.
- We'll act in a proportionate way and, where the law requires it and it's safe to do so, tell you what we decided and why, and how you can ask us to look again. You can contest a decision by emailing aakashnandrajog.work@gmail.com.
- If we believe someone is in immediate danger, or a crime involving a child may have been committed, we may share information with the authorities.
- You can stop using IceBreaker and delete your account whenever you like. We may stop offering IceBreaker; if we do, we'll give you reasonable notice where possible.
9. Price
IceBreaker is currently free. If we ever introduce paid features, we'll tell you the price and terms clearly before you pay, and you'll have all the rights EU consumer law gives you.
10. Our responsibility to you
We work hard to keep IceBreaker running smoothly and safely, but we provide it "as is" and can't promise it will always be available, error-free, or that you'll meet someone.
To the extent the law allows, we are not responsible for:
- how other users behave, on or off the app, or the content they post;
- losses that weren't reasonably foreseeable, or that were caused by your own breach of these terms;
- interruptions caused by events beyond our reasonable control.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence (dolo o colpa grave, as provided by Article 1229 of the Italian Civil Code), or any other liability that cannot be limited or excluded by law. Nothing in these terms affects your statutory rights as a consumer, including those under the Italian Consumer Code (Codice del Consumo).
11. Changes to these terms
We may update these terms when the app or the law changes. If a change is significant, we'll let you know in the app before it takes effect. If you don't agree with the new terms, you can delete your account at any time.
12. Governing law and disputes
These terms are governed by Italian law. If you're a consumer living in another EU country, you also keep the protection of the mandatory rules of the law of your country. Any dispute can be brought before the courts of the place where you live, as provided by consumer law.
We'd always prefer to sort things out directly — please email us first. You can also use an out-of-court consumer dispute resolution body (ADR) recognised in Italy.
13. General
If any part of these terms turns out to be invalid, the rest still applies. If we don't enforce a right straight away, we haven't given it up. You may not transfer your rights under these terms to anyone else.
